Korea University (KU) School of Law students are to start suit for damages against a domestic company in representation of the citizens of Myanmar. According to KU College of Law, Clinical Legal Education Center (CLEC) (an affiliate of KU School of Law) and Yi Gong Lawyers will work together to represent 20 Myanmar citizens in a damage suit against Posco Daewoo (previously known as Daewoo International). Each person is filing for 10,000,000 won in damage costs.

This lawsuit against Posco Daewoo may pave way to a social dispute as it involves a clash between protection of foreign citizens’ rights and the interests of a domestic company. CLEC has been known to have been preparing for this case, taking from the previous example of the case against Unocol Corporation, a United States-based (U.S.) oil conglomerate.

Non-governmental organizations (NGOs) had filed a damage suit against Unocol Corporation claiming that the corporation had inflicted forced labor, deportation, and other acts against human rights on the citizens of Myanmar. This lawsuit lasted nearly 10 years and finally in 2005, the victory virtually went to the citizens of Myanmar as Unocol Corporation agreed to pay large sums of damage costs to Myanmar citizens.

On the significance of its lawsuit, KU School of Law personnel said, “We are focusing on creating a good example for Korea to provide Myanmar citizens with stable living environment as well as promoting a positive image for domestic companies so that they can enter the Myanmar market with more ease.”
