EU¡¯s rules and law-based foreign policy for cyberspace

Korea University-Graduate School of Information Security is proud to announce a guest lecture by Mr Michael Reiterer, Ambassador of the European Union to the Republic of Korea. This is a special lecture for the graduate course ¡®advanced cyber law¡¯ (Prof Gertjan Boulet).
Abstract
Foreign policy is always a function of domestic policies. Therefore, as cyber presents a new challenge not only to society, the way we operate and plan ahead (4thIndustrial Revolution), it has also entered over the last two decades international relations. "Twiplomacy" is somehow a reflection of this trend.
With the Liberal International Order under besiege, the EU¡¯s leadership in promoting ¡®an open, free, stable and secure cyberspace¡¯ is now more critical than ever before. This is hardly surprising given that many states increasingly see cyberspace as an environment in which they can pursue their strategic objectives free of the constraints posed by physical borders.
The EU¡¯s recognition of the need for a common and comprehensive response signals that the Union intends to make a better use of existing diplomatic tools in defense of its interests and values. As the EU pursues a rules and law based foreign policy, the question of the applicability of international law to the cyber domain is important. The discussion about states¡¯ sovereignty in cyberspace is intensifying while progress towards a stability regime for the digital domain – based on norms, international law, and confidence building measures – remains slow. Cyber-crimes also challenge international criminal law and the cooperation of states.
Following the Council Conclusions on Cyber Diplomacy adopted in February 2015, the decision by the EU Ministers of Foreign Affairs to endorse the development of a framework for a joint EU diplomatic response to malicious cyber activities – the so-called Cyber Diplomacy Toolbox (CDT) – demonstrates that the EU has taken up the challenge.
