KoreaUniversity-Graduate School of Information Security is proud to announce a guestlecture by Mr Michael Reiterer, Ambassador of the European Union to theRepublic of Korea. This is a special lecture for the graduate course ¡®advancedcyber law¡¯ (Prof Gertjan Boulet).
Abstract
Foreignpolicy is always a funtion of domestic policies. Therefore, as cyber presents anew challenge not only to society, the way we operate and plan ahead(4thIndustrial Revolution), it has also entered over the last two decadesinternational relations. "Twiplomacy" is somehow a reflection of thistrend.
With theLiberal International Order under besiege, the EU¡¯s leadership in promoting ¡®anopen, free, stable and secure cyberspace¡¯ is now more critical than everbefore. This is hardly surprising given that many statesincreasingly see cyberspace as an environment in which they can pursue theirstrategic objectives free of the constraints posed by physical borders.
The EU¡¯srecognition of the need for a common and comprehensive response signals thatthe Union intends to make a better use of existing diplomatic tools in defenseof its interests and values. As the EU pursues a rules and law based foreignpolicy, the question of the applicability of international law to the cyberdomain is important. The discussion about states¡¯ sovereignty in cyberspace isintensifying while progress towards a stability regime for the digital domain –based on norms, international law, and confidence building measures – remainsslow. Cyber-crimes also challenge international criminal law and thecooperation of states.
Followingthe Council Conclusions on Cyber Diplomacy adopted in February 2015, thedecision by the EU Ministers of Foreign Affairs to endorse the development of aframework for a joint EU diplomatic response to malicious cyber activities –the so-called Cyber Diplomacy Toolbox (CDT) – demonstrates that the EU hastaken up the challenge.
